Ofgem’s Decision: A Setback for Industry Standards
The recent decision by Ofgem to reject the proposal to mandate the Third-Party Intermediary (TPI) Code of Practice under the Retail Energy Code (REC) represents a pivotal moment for our industry.
While we recognise the legal and competition concerns outlined by Ofgem, this outcome is disappointing.
It leaves the door open for poor practices to persist in some parts of the market — weakening trust in energy brokers at a time when transparency and accountability are more important than ever.
This decision, however, will not deter the Energy Consultants Association (ECA) from our mission.
On the contrary, it strengthens our resolve to lead the way in raising standards and representing those who operate ethically and professionally.
Understanding Ofgem’s Decision — and Its Implications
Ofgem’s decision was based on concerns around the limits of its statutory authority.
Specifically, the regulator stated it does not currently have the legal power to mandate a TPI Code of Practice because TPIs are not directly regulated under its remit.
While that legal point is acknowledged, the implications are significant:
- There remains no enforceable framework to hold non-compliant brokers to account.
- Voluntary self-regulation remains the only practical route to upholding standards.
- The industry must now rely even more heavily on collective responsibility — something the ECA is proud to champion.
We believe this creates both a challenge and an opportunity: without a regulatory safety net, it becomes even more important that reputable brokers stand together, lead by example, and continue to drive progress through collaboration, accountability, and professionalism.
Why Voluntary Compliance Still Matters — and Always Will
With mandatory regulation off the table for now, voluntary adoption of the TPI Code of Practice becomes more important than ever.
We strongly encourage all members — and non-members — to adopt the Code in full.
Why it matters:
- It builds trust: Clients and suppliers want to know they are working with brokers who operate transparently, ethically, and in their best interest.
- It provides protection: Following the Code helps reduce risk of disputes, complaints, or reputational damage.
- It future-proofs your business: Should regulation arrive in the future, brokers already aligned with the Code will be best positioned to adapt.
ECA in Action: Advocacy, Education, and Accountability
Over the past 12 months, the ECA has worked tirelessly to provide value and leadership in the absence of direct regulation:
- We’ve responded to every major REC consultation affecting TPIs, putting broker interests at the heart of the conversation.
- We’ve defended the industry in the media, challenging negative portrayals and correcting misinformation.
- We’ve hosted webinars, shared compliance tips, and created resources used by over 70 member businesses.
- We’ve grown our influence, with representation from our executive team at key industry events, including the upcoming Energy Live News Conference 2025.
Chris Shaw, CEO of Utility Bidder and ECA Chair, and Richard Price, Managing Director of Tickd and ECA Executive Member, will be speaking at ELN Conference 2025.
Their attendance underlines our growing voice in the national energy conversation.
